General terms and conditions of sale

These General Terms and Conditions of Sale govern the offer and sale of products through the sales section of the website www.jubileeofficialstore.com (referred to as the "Store" and the "Site," respectively). 

The company S4 Giubileo s.r.l. owns the Site and the Store, holding the domain names, trademark, and the Official Logo "Giubileo 2025"; 

The products marketed on the Store ("Products") are offered and sold by S4 Giubileo s.r.l. (VAT number 17255001004) on behalf of the legal representative and sole administrator Mr. Stefano D’Ambrosio (Tax Code DMB SFN 68C26 H501Y), with registered office in Rome (RM) at Via Della Giustiniana no. 990.

  1. Scope of Application and Website Navigation 

1.1 The offer and sale of Products on the Store constitute a distance contract governed by Chapter I, Title III (Articles 45 and following) of Legislative Decree 6 September 2005, no. 206 ("Consumer Code") and by Legislative Decree 9 April 2003, no. 70, containing the regulations on electronic commerce. 

1.2 These General Terms and Conditions of Sale apply to all sales made by S4 GIUBILEO S.R.L. on the Store. 

1.3 The General Terms and Conditions of Sale may be amended at any time. Any amendments and/or new conditions will be effective from the moment of their publication on the Store. Users are therefore invited to regularly access the Store and consult, before making any purchase, the most updated version of the General Terms and Conditions of Sale. 

1.4 The applicable General Terms and Conditions of Sale are those in force on the date of submission of the purchase order. 

1.5 These General Terms and Conditions of Sale do not govern the sale of products and/or the provision of services by subjects other than S4 GIUBILEO S.R.L. that are present on the Store via links, banners, or other hypertext links. Before carrying out commercial transactions with such subjects, it is necessary to verify their sales conditions. S4 GIUBILEO S.R.L. is not responsible for the provision of services and/or for the sale of products by such subjects. S4 GIUBILEO S.R.L. does not carry out any control and/or monitoring on the websites accessible through such links. S4 GIUBILEO S.R.L. is therefore not responsible for the content of such sites nor for any errors and/or omissions and/or violations of law by them. 

1.6 The user is required to carefully read these General Terms and Conditions of Sale, which S4 GIUBILEO S.R.L. makes available in the appropriate section and of which the user is allowed to store and reproduce, as well as all other information that S4 GIUBILEO S.R.L. provides on the Site and/or the Store, both before and during the purchase procedure. 

1.7 The Site allows each user to browse and, upon registration, make purchases on the respective Store, regardless of the country in which the user is physically located at the time of accessing the Store. 

2. Purchases on the Store 

2.1 The purchase of Products on the Store is only allowed for individuals who: 

i. are 18 years of age or older;

ii. qualify as consumers, meaning natural persons who, in relation to the purchase of Products, act for purposes outside their commercial, business, professional, or artisanal activity, if any;

iii. are registered on the Site, as provided for in Article 3 below. 

2.2 Retailers, wholesalers, or generally anyone intending to purchase Products for the purpose of subsequent resale are not allowed to make purchases on the Store under any circumstances. Therefore, it is prohibited for such individuals and anyone who is not a consumer to register on the Site and make purchases on the Store. Furthermore, individuals referred to in Article 10.10 are also prohibited from making purchases. 

2.3 In the event of violation of these prohibitions or in the case of orders, from any source, that are abnormal in relation to the quantity of products purchased or the frequency and/or mode of purchases made, S4 GIUBILEO S.R.L. reserves the right to take all necessary actions to cease the irregularities, including suspending access to the Site and/or the Store, canceling registration, or not accepting or canceling irregular orders. 

2.4 S4 GIUBILEO S.R.L. also reserves the right to refuse or cancel orders coming from: 

i. a user with whom it has a legal dispute ongoing;

ii. a user who has previously violated the terms and/or conditions of the purchase contract with S4 GIUBILEO S.R.L.;

iii. a user who has been involved in any type of fraud, particularly fraud related to credit card payments; 

iv. users who have provided false, incomplete, or otherwise inaccurate identification data or who have not promptly sent to S4 GIUBILEO S.R.L. the information and/or documents requested by it in the context of the procedure referred to in Article 9.3 below, or who have submitted invalid documents.

3. Registration to the Site 

3.1 The purchase of Products on the Store can only be done after registering on the Site. 

3.2 Registration on the Site is free. To register on the Site, the user must fill out the appropriate form, entering their name, surname, title, an email address, and a password, and clicking on "Register." The successful registration on the Site will be confirmed to the user via a specific email. 

3.4 Registration on the Site, by opening a personal account, allows the user to: 

i. save their addresses;

ii. access all information related to orders and returns;

iii. track the status of the order; 

iv. manage their personal data and update them at any time.

3.5 The registration credentials (email address and password) allow the user to make purchases on the Store. In any case, the registration credentials must be kept extremely carefully and attentively, may only be used by the user, and may not be transferred to third parties. The user undertakes to keep them secret and to ensure that no third party has access to them. The user also undertakes to immediately inform S4 GIUBILEO S.R.L. in case of suspected or known unauthorized use or disclosure of the credentials. 

3.6 The user guarantees that the personal information provided during the Site registration process is complete and truthful and undertakes to hold S4 GIUBILEO S.R.L. harmless and indemnified from any damage, compensation obligation, and/or sanction arising from and/or in any way connected to the user's violation of the rules on Site registration or the storage of registration credentials. 

3.7 Registration on the Site constitutes acceptance of these General Terms and Conditions of Sale. 

4. Information Directed to Contract Conclusion 

4.1 In accordance with Legislative Decree April 9, 2003, no. 70 containing provisions on electronic commerce, S4 GIUBILEO S.R.L. informs the user that: 

i. to conclude the purchase contract of one or more Products on the Store, the user must fill out an electronic order form and transmit it to S4 GIUBILEO S.R.L., electronically, following the instructions that will appear on the Store from time to time;

ii. the contract is concluded when the order form reaches the server of S4 GIUBILEO S.R.L.;

iii. before proceeding with the transmission of the order form, the user may identify and correct any input errors following the instructions on the Store; 

iv. once the order form is registered and confirmation of the validity of the payment method used is received, S4 GIUBILEO S.R.L. will send the user, to the email address provided, the order confirmation containing: a summary of the General Terms and Conditions of Sale, as well as any special conditions applicable to the contract, information regarding the essential characteristics of the purchased Product, a detailed indication of the price, the payment method used, delivery charges, and any additional costs, as well as information on the right of withdrawal or its exclusion; the General Terms and Conditions of Sale applicable to the order and standard withdrawal instructions;

v. the order form will be stored in the S4 GIUBILEO S.R.L. database for the time necessary for its execution and, in any case, within the terms of the law. To access their order form, the user can consult the "Account" section of the Store.

4.2 The languages available to users for concluding the contract are Italian and English. Customer Service is able to communicate with users in the same languages. 

5. Product Availability 

5.1 The Products offered on the Store are the items listed in the electronic catalog published on the Store at the time of the user's order placement. 

5.2 The availability of Products is continuously monitored and updated. However, since the Store can be visited by multiple users simultaneously, it may happen that multiple users purchase the same Product at the same time. In such cases, the Product may temporarily appear available, while it is actually sold out or not immediately available, requiring replenishment. Provisions regarding Pre-Order Products are exempt from this. 

5.3 If the Product is unavailable for the reasons mentioned above or in other cases of subsequent unavailability of the Product, subject to the other rights granted to the user by law and, in particular, by Chapter XIV of Title II of Book IV of the Civil Code, S4 GIUBILEO S.R.L. will immediately notify the user via email. The user will then be entitled to immediately terminate the contract, except for the right to compensation for damages, pursuant to and for the purposes of Article 61, IV and V paragraph, of the Consumer Code. 

Alternatively, and without prejudice to this right, the user may accept one of the following proposals from S4 GIUBILEO S.R.L.: 

i. if replenishment of the Product is possible: an extension in delivery times, with S4 GIUBILEO S.R.L. specifying the new delivery date of the replenished Product;

ii. if replenishment of the Product is not possible: the supply of a different product of equivalent or superior value, subject to payment, in the latter case, of the difference, and subject to the express acceptance of the user.

The user's choice must be promptly communicated to S4 GIUBILEO S.R.L., by email, at the address indicated in Article 14 below. 

5.4 In the event that the user exercises the right of withdrawal pursuant to Article 61, IV and V paragraph, of the Consumer Code, and the payment of the total amount due - consisting of the price of the Product, delivery charges, if applicable, and any other additional costs, as resulting from the order - has already been made, S4 GIUBILEO S.R.L. will refund the Total Amount Due without undue delay and, in any case, within 15 working days from the order dispatch date. The refund amount will be communicated to the user via email and credited to the same payment method used by the user for the purchase. In the case of payment by bank transfer, S4 GIUBILEO S.R.L. will request the user's bank details necessary for the refund. Any delays in crediting may depend on the bank, the type of credit card, or the payment solution used. In any case, the value date of the credited amount will be the same as the debit date. 

6. Product Information 

Each Product is accompanied by an information sheet illustrating its main characteristics. The images and descriptions on the Store reproduce the characteristics of the Products as faithfully as possible. 

7. Prices 

7.1 All prices of the Products published on the Store are expressed in Euro (or in the local currency, outside the European perimeter) and are inclusive of Value Added Tax - VAT. 

7.2 S4 GIUBILEO S.R.L. reserves the right to change the price of the Products at any time without notice, provided that the price charged to the user will be the one indicated on the Store at the time of placing the order, and any subsequent variations (increase or decrease) will not be taken into account after the order has been transmitted. 

8. Purchase Orders 

8.1 The Products will remain the property of S4 GIUBILEO S.R.L. until the user has paid the Total Amount Due. In the event that the Total Amount Due is not paid or the successful payment outcome is not confirmed, the purchase contract shall be deemed terminated by operation of law pursuant to and for the effects of Article 1456 of the Italian Civil Code, without prejudice to what is provided for in Article 9.3. The user will be notified via email of the contract termination and the consequent cancellation of the order. 

8.2 S4 GIUBILEO S.R.L. will ship the Products only after receiving confirmation of successful payment of the Total Amount Due from the user. The risk of loss or damage to the Products not attributable to S4 GIUBILEO S.R.L., however, will be transferred to the user when the user, or a third party designated by the user and other than the carrier, physically takes possession of the Products. 

8.3 In the event that, following the purchase of a Product and its receipt by the user, the user wishes to replace it - subject to the rights that the user may enjoy under the law - the replacement will be possible only within 14 days from the date the purchased Product was delivered to the user, provided that: (i) the returned Product is intact and complete with any accessories, labels, instruction sheets, and inserted in its original packaging, along with a copy of the purchase invoice, and (ii) the Product requested by the user as a replacement for the purchased one is available from S4 GIUBILEO S.R.L. 

Upon verifying that the replacement procedure under this Article 8.3 has been correctly followed by the user, S4 GIUBILEO S.R.L. will: 

(i) without undue delay, and in any case within 7 working days from the receipt of the package containing the returned Product, refund the user the Total Amount Due (excluding delivery charges, if applicable, and any other additional costs, as resulting from the order) paid by the user in relation to the returned Product. The refund will be made to the same payment method used for the initial purchase, and the user will receive an email confirmation of the refund; 

(ii) at the time the replacement Product is dispatched by S4 GIUBILEO S.R.L. to the user, charge the user for the price of that Product (regardless of whether it is the same, lower, or higher than the price of the initially purchased Product) on the same payment method used for the initial purchase. At the time of shipment, the user will also receive an email confirmation of the shipment; 

(iii) upon receipt of the package containing the Product that the user wants to replace, deliver to the user the chosen replacement Product within the delivery terms and with the commencement indicated in the instructions under Article 8.3, second paragraph, above. 

9. Payment Methods 

9.1 Payment for the Products purchased on the Store can be made: 

  • by credit card, using one of the credit cards accepted by S4 GIUBILEO S.R.L.; 
  • through the PayPal payment solution; 
  • by bank transfer to the coordinates indicated on the website. 

If one or more of the payment methods listed above cannot be used, possibly also in relation to a specific Product or type of Product, this will be indicated on the Store at the beginning of the purchase process or, at the latest, before the user completes the purchase and submits the order. In any case, the unavailable payment method(s) cannot be selected by the user during the purchase process. 

S4 GIUBILEO S.R.L. uses the secure payment service provided by Shopify Payments, which involves the use of SSL protocol. The confidential data of the credit card (card number, start date, expiration date, security code) or PayPal account (email address and password) are encrypted and transmitted directly to the payment processor without passing through S4 GIUBILEO S.R.L. servers, thus S4 GIUBILEO S.R.L. never has access to, and does not store, such data. 

9.2 In the case of payment via PayPal, the user will be redirected to the www.paypal.com website, where they will make the payment for the Products according to the procedure provided and governed by PayPal and the terms and conditions of contract agreed between the user and PayPal. The data entered on the PayPal website will be processed directly by PayPal and will not be transmitted or shared with S4 GIUBILEO S.R.L. Therefore, S4 GIUBILEO S.R.L. is not able to know or store in any way the credit card data linked to the user's PayPal account or the data of any other payment instrument connected to that account. 

9.3 In order to ensure the security of payments made on the Store and prevent any fraud, S4 GIUBILEO S.R.L. reserves the right to request from the user, via email, to send, via the same means, a copy of their valid identity card, and, in case the order holder is different from the credit card or PayPal account holder, the identity card of the latter; S4 GIUBILEO S.R.L. may also request, alternatively or in addition to the above, the authorization code related to the transaction of the order issued by the user. The email requesting the document will specify the deadline by which the document must reach S4 GIUBILEO S.R.L. Such deadline will not, in any case, exceed 5 working days from the receipt of the request by the user. Pending the requested information and/or document, the order will be suspended. The user is required to send the requested information and/or documents within the specified deadline. In case S4 GIUBILEO S.R.L. does not receive such information and/or documents within the term specified in the email request or receives incorrect or incomplete information and/or expired or invalid documents, the contract shall be deemed terminated by operation of law pursuant to and for the effects of Article 1456 of the Italian Civil Code, and the order consequently canceled, without prejudice to S4 GIUBILEO S.R.L.'s right to compensation for any damages it may incur due to the user's non-compliant behavior. The termination of the contract, of which the user will be notified via email, within and not later than 5 days from the expiry of the deadline for sending the information and/or documents requested by S4 GIUBILEO S.R.L., will result in the cancellation of the order and the refund of the Total Amount Due possibly already paid by the user, with the application of the refund methods provided above, to the extent compatible. In the event of receipt by S4 GIUBILEO S.R.L. of valid information and/or documentation within the specified deadline, the delivery terms applicable to the Product will start from the date of receipt of the same. 

9.4 In any case, the commercial invoice will be issued at the time of shipment and will be sent by email to the user, at the address they have registered. 

10. Product Delivery 

10.1 The delivery of the Products purchased on the Store is made to the shipping address indicated by the user in the order form, upon payment of the Total Amount Due. 

10.2 Delivery cannot be made to locations in the Republic of San Marino or to post office boxes or post restante. If the shipping address is to a post office box or post restante or in one of the indicated locations, S4 GIUBILEO S.R.L. will proceed to terminate the contract pursuant to and for the effects of Article 1456 of the Italian Civil Code and to refund the Total Amount Due, if already paid, with the methods and within the terms of Article 5.4 above. 

10.3 The shipping costs of the Products, which may vary depending on the shipping method chosen by the user, and any other additional costs are borne by the user, unless otherwise indicated in the Product Sheet or in other parts where communicated. Their amount will be expressly and separately indicated (in Euros and including VAT) in the Product Sheet and in the order summary and, in any case, before the user proceeds with the transmission of the order, as well as in the order confirmation email. 

If it is necessary to proceed with the refund of the delivery costs with reference to the case of withdrawal from a Multiple Order, S4 GIUBILEO S.R.L. will refund the cost of such expenses only where the user intends to withdraw from the entire Multiple Order, in which case, the cost will be refunded in full. Otherwise, the refund will not take place, considering that the delivery expenses incurred by the user (which S4 GIUBILEO S.R.L. always calculates in a fixed amount, regardless of the number of Products ordered) are attributable to the delivery of the other Products, different from those for which the user exercised the withdrawal, forming part of the Multiple Order. 

If instead the refund of the delivery costs follows the unavailability of one of the Products forming part of the Multiple Order or one of the cases of default by S4 GIUBILEO S.R.L., the latter will refund the delivery costs to the user. 

In no case, the amount of the delivery costs to be refunded may exceed the amount of the expenses actually paid by the user for the delivery. 

10.4 The delivery times are those indicated in the Product Sheet, before the user submits the order, and in the order confirmation email. They start from the order dispatch date. In case of omission of a delivery term, it will take place, in any case, within thirty days from the date of conclusion of the contract. Delivery times are calculated considering only working days and therefore excluding Saturdays, Sundays, and public holidays. 

10.5 At the time of shipment, i.e., when the Products are delivered to the carrier, an email confirmation of the shipment will be sent to the user, containing a link to track the progress of the shipment. 

10.6 Deliveries will be made through the carrier identified from time to time, from Monday to Friday during normal office hours, excluding national holidays. S4 GIUBILEO S.R.L. reserves the right to use other carriers and/or different delivery methods. In such case, the change will be indicated in the Product Sheet or with another dedicated communication. 

10.7 The obligation to deliver is fulfilled by transferring the material availability or otherwise the control of the Products to the user. 

10.8 It is the user's responsibility to check the condition of the Product that has been delivered to them. While the risk of loss or damage to the Products, due to causes not attributable to S4 GIUBILEO S.R.L., is transferred to the user when the user, or a third party designated by them and different from the carrier, physically takes possession of the Products, it is recommended that the user checks the integrity of the packaging and the number of Products received and, if possible, indicates any anomalies on the carrier's transport document. In case the package shows obvious signs of tampering or alteration, the user is recommended to promptly notify the Customer Service. The application of the rules on the right of withdrawal and legal warranty of conformity remains in force. 

10.9 The user acknowledges that the retrieval of the Product is their specific obligation arising from the purchase contract. In case of non-delivery due to the absence of the recipient at the address specified in the order form, the carrier will leave a notice of passage in the letterbox containing the number to contact them. The carrier will then make a second delivery attempt. After two unsuccessful delivery attempts, the package will go into "storage". The Customer Service will then send an email to the user to unlock the storage and ensure that the package is delivered to them as soon as possible. If necessary, the Customer Service may agree with the user to change the shipping address. If this attempt also fails or the user does not respond to the Customer Service's attempt to contact them, the Product will be returned to S4 GIUBILEO S.R.L., and, in any case, after 30 working days from the first delivery attempt, the contract will be deemed terminated and the purchase order consequently canceled pursuant to Article 1456 of the Italian Civil Code. S4 GIUBILEO S.R.L. will then, within 15 working days following the termination of the contract, refund the Total Amount Due paid by the user, minus the expenses of the unsuccessful delivery of the Product, the return expenses to S4 GIUBILEO S.R.L., and any other expenses incurred by it due to the failed delivery caused by the absence of the recipient. The termination of the contract and the amount of the refund will be communicated to the user via email. The refund will be credited to the same payment method used by the user for the purchase. If the user has made the payment by bank transfer, S4 GIUBILEO S.R.L. will request the user's bank details necessary for the refund. Any delays in crediting may depend on the banking institution, the type of credit card used, or the payment solution used. In any case, the value date of the refunded amount will be the same as the debit date. 

In the event that, before the expiration of the thirty-day period, the user requests to receive the Product again, S4 GIUBILEO S.R.L. will proceed with the new delivery, charging, in addition to the delivery costs, the costs of returning the Product to S4 GIUBILEO S.R.L. and the storage costs. 

10.10 In the event that the purchased Product is not delivered or is delivered late compared to the delivery terms indicated in the Product Sheet and in the order confirmation, the user, pursuant to Article 61 of the Consumer Code, invites S4 GIUBILEO S.R.L. to make the delivery within an additional term appropriate to the circumstances ("Additional Term pursuant to Article 61, paragraph III, Consumer Code"). If this additional term expires without the Products being delivered, the user is entitled to terminate the contract ("Contract Termination pursuant to Article 61, paragraph III, Consumer Code"), without prejudice to the right to compensation for damages. 

The user is not burdened with the obligation to grant S4 GIUBILEO S.R.L. the Additional Term pursuant to Article 61, paragraph III, Consumer Code ("Excluded Cases") if: 

a) S4 GIUBILEO S.R.L. has expressly refused to deliver the Products;

b) compliance with the delivery term indicated during the purchase process and in the order confirmation is to be considered essential, taking into account all the circumstances that accompanied the conclusion of the contract;

c) the user informed S4 GIUBILEO S.R.L., before the conclusion of the contract, that delivery by or on a specific date is essential.

In Excluded Cases, the user, if they do not receive the Products within the delivery term indicated during the purchase process and in the order confirmation, is entitled to immediately terminate the contract, without prejudice to the right to compensation for damages ("Contract Termination in Excluded Cases"). 

The indication of the Additional Term pursuant to Article 61, paragraph III, Consumer Code and the communication of Contract Termination pursuant to Article 61, paragraph III, Consumer Code or Contract Termination in Excluded Cases must be communicated by the user to S4 GIUBILEO S.R.L. at the addresses provided in Article 14 below. 

In the event of Contract Termination pursuant to Article 61, paragraph III, Consumer Code or Termination in Excluded Cases, S4 GIUBILEO S.R.L. will refund the Total Amount Due to the user without undue delay. The refund will be made in accordance with the methods set out in Article 10.15 below. 

If the user does not proceed to set the Additional Term pursuant to Article 61, paragraph III, Consumer Code or, if the conditions are met, to Contract Termination pursuant to Article 61, paragraph III, Consumer Code or Termination in Excluded Cases, without prejudice to the user's right to avail themselves of these remedies and/or the ordinary means of protection provided by law and, in particular, by Chapter XIV of Title II of Book IV of the civil code, S4 GIUBILEO S.R.L. undertakes to: 

i. Give timely communication to the user via email regarding the delay in delivery ("Delay Notification Email"), simultaneously indicating the new delivery date, if available ("New Delivery Date");

ii. In case of delivery with a delay of between 1 and 3 working days compared to the New Delivery Date, refund the user the delivery costs, if already paid, within 10 working days from the expiration of the New Delivery Date or waive payment if not yet paid;

iii. In case of delivery with a delay of between 4 and 10 working days compared to the New Delivery Date, allow the user, upon request, to refuse delivery and partially terminate the contract solely with reference to the Product delivered late within the Multiple Orders, with consequent reimbursement - immediately and, in any case, within 10 working days from the request for partial contract termination - only of the amount paid by the user in relation to that specific Product, including delivery costs, calculated as indicated in Article 10.3 above, or, alternatively, if the user does not want to partially terminate the contract, refund the user - within 10 working days from the request - the delivery costs, if already paid, calculated as indicated in Article 10.3 above, or waive payment if not yet paid. Full termination of the Multiple Order will only be possible if the Products subject to the Multiple Order delivered late or not delivered are clearly and demonstrably ancillary to the other Products subject to the Multiple Order delivered on time or yet to be delivered; 

iv. In case of delay in the delivery of one of the Products subject to the Multiple Order exceeding 10 working days compared to the New Delivery Date or, in any case, 20 days compared to the original delivery date, offer the user, in addition to what is provided for in Article 10.11 (iii) above, the supply of a different Product of equivalent or higher value, subject to payment, in the latter case, of the difference and subject to the express consent of the user.

10.12 In the event of non-sending of the Delay Notification Email or failure to specify the New Delivery Date in it, all the deadlines referred to in Articles 10.10 (ii), (iii), and (iv) and 10.11 (ii), (iii), and (iv) above will start from the original delivery date. 

10.13 Acceptance of the New Delivery Date and in cases referred to in Articles 10.10 (iii) and (iv) and 10.11 (iii) and (iv) above, the user's choice must be promptly communicated to S4 GIUBILEO S.R.L. via email at the address provided in Article 14 below. 

10.15 In all cases referred to in Articles 10.10 and 10.11 above where a refund is due to the user, the refund amount will be communicated to the user via email. It will be credited to the same payment method used by the user for the purchase. In case of payment by bank transfer, S4 GIUBILEO S.R.L. will request the user's bank details necessary for the refund. Any delays may depend on the bank, the type of credit card used, or the payment solution used. In any case, the value date of the refunded amount will be the same as the debit date. 

11. Right of Withdrawal 

11.1 The user who qualifies as a consumer has the right to withdraw from the product purchase contract without giving any reason and without incurring costs other than those provided for in Article 11.7 below, within fourteen calendar days. The withdrawal period ("Withdrawal Period") expires after 14 days: 

a) in the case of an order relating to a single product, from the day the user or a third party, other than the carrier and designated by the user, acquires physical possession of the products;

b) in the case of Multiple Orders with separate deliveries, from the day the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last product;

c) in the case of an order relating to the delivery of a product consisting of multiple lots or pieces, from the day the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece.

11.2 To exercise the right of withdrawal, the user must inform S4 GIUBILEO S.R.L., before the expiry of the Withdrawal Period, of their decision to withdraw. 

11.3 For this purpose, the user may submit any other explicit statement of their decision to withdraw from the contract ("Withdrawal Statement"). 

11.4 The user has exercised their right of withdrawal within the Withdrawal Period if the communication regarding the exercise of the right of withdrawal is sent before the expiry of the Withdrawal Period. The consumer is invited to indicate in the Withdrawal Statement the order number, the product(s) for which they intend to exercise the right of withdrawal, and their address. Since the burden of proof regarding the exercise of the right of withdrawal before the expiry of the Withdrawal Period lies with the user, it is in the user's interest to use a durable medium when communicating their withdrawal to S4 GIUBILEO S.R.L. 

11.5 The user must then return the products to S4 GIUBILEO S.R.L., without undue delay and in any case within 14 calendar days from the date on which they communicated their decision to withdraw to S4 GIUBILEO S.R.L. The deadline is met if the user returns the products before the expiry of the fourteen-day period. For the return, the user must follow the procedure indicated in Article 11.6 below, as well as in the standard withdrawal instructions, which also contain information on exercising the right of withdrawal, and are made available to the user both on the Store, before the conclusion of the contract, and attached to the order confirmation email. 

11.6 Within the period indicated in Article 11.5 above, the user who returns the product from the same country in which the product was delivered to them must return it, properly protected and packaged, via the courier ____. The user can contact ______, whose contact details are indicated in the standard withdrawal instructions, to arrange the date and place for the parcel pickup. In this case, the user will only pay the return shipping costs but will not bear the risk of loss or damage to the product during shipment. 

The procedure described above is available only if the user returns the product from the same country in which the product was delivered to them, as indicated in the order confirmation email (e.g., if the user who purchased product X requested that it be delivered to them in Italy, the prepaid return procedure described in this paragraph can only be used if the pickup location of the product subject to withdrawal is in Italy). Otherwise, if the user wishes to return the product subject to withdrawal from a country different from the one (indicated in the order confirmation email) where the delivery took place, the return of the product to S4 GIUBILEO S.R.L. must be made, without undue delay and in any case within 14 calendar days from the date on which the user communicated their decision to withdraw to S4 GIUBILEO S.R.L., using a carrier of the user's choice and at the user's expense. The deadline is met if the user returns the product before the expiry of the aforementioned fourteen-day period. The product, properly protected and packaged, must be sent to the following address:

In the case just described, the direct costs of returning the product (including any customs duties) to S4 GIUBILEO S.R.L. are borne by the user, and the return of the product to S4 GIUBILEO S.R.L. is at the user's own risk. In any case, for the purpose of the deadline for returning the product as referred to in Article 11.5 above, the product is considered returned when it is delivered, within the aforementioned period, to the courier indicated by S4 GIUBILEO S.R.L., or, depending on the circumstances, to the accepting post office/the courier chosen by the user. 

11.7 The user is solely responsible for any decrease in the value of the goods resulting from handling of the product other than that necessary to establish the nature, characteristics, and functioning of the product. The product must be kept, handled, and inspected with ordinary diligence and returned intact, complete in every part, fully functional, accompanied by all accessories and instruction leaflets, with identification tags and labels, if any, still attached to the product and intact and unaltered, as well as perfectly suitable for the intended use and free from signs of wear or dirt. The right of withdrawal also applies to the product as a whole. It cannot therefore be exercised in relation to parts and/or accessories of the product. 

11.8 If the withdrawal is not exercised in accordance with the applicable law, it will not result in the termination of the contract and, consequently, will not entitle to any refund. S4 GIUBILEO S.R.L. will inform the user within 5 working days from the receipt of the product, rejecting the withdrawal request. The product, if already received by S4 GIUBILEO S.R.L., will remain at the latter's disposal for collection by the user, which must take place at the user's expense and under their responsibility. 

11.9 If the product for which the withdrawal has been exercised has undergone a decrease in value resulting from handling of the product other than that necessary to establish the nature, characteristics, and functioning of the product, the refund amount will be reduced by an amount equal to that decrease in value. S4 GIUBILEO S.R.L. will inform the user of this circumstance and the consequent reduced refund amount within 5 working days from the receipt of the product, providing the user, if the refund has already been paid, with the bank details for the payment of the amount due by the user due to the decrease in value of the product. 

11.10 In the event that, under one of the legal provisions, the right of withdrawal does not apply, specific and express communication of such exclusion will be given in the Product Sheet and, in any case, during the purchase process, before the user proceeds to submit the order. 

12. Legal Warranty of Conformity 

12.1 All products sold on the Store are covered by the Legal Warranty of Conformity provided for by Articles 128-135 of Legislative Decree No. 206/2005 ("Consumer Code") ("Legal Warranty"). 

12.2 TO WHOM IT APPLIES 

The Legal Warranty is reserved for consumers. Therefore, it applies only to users who have made purchases on the Store for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity they may carry out. 

12.3 WHEN IT APPLIES 

The seller (and therefore, for purchases made on the Store, S4 GIUBILEO S.R.L..) is liable to the consumer for any lack of conformity existing at the time of delivery of the product and which becomes apparent within two years from that delivery. The lack of conformity must be reported to the seller, under penalty of forfeiture of the warranty, within two months from the date on which it was discovered. 

Unless proven otherwise, it is presumed that any lack of conformity that becomes apparent within six months from the delivery of the product already existed at that time, unless this presumption is incompatible with the nature of the product or the nature of the lack of conformity. Starting from the seventh month following the delivery of the product, it will be the consumer's responsibility to prove that the lack of conformity already existed at the time of delivery. 

In order to benefit from the Legal Warranty, the user must therefore provide proof of the date of purchase and delivery of the goods. Therefore, it is advisable for the user to retain the purchase invoice, which S4 GIUBILEO S.R.L. sends them, as well as the delivery note or any other document that can attest to the date of purchase (for example, the credit card statement or bank statement) and the date of delivery. 

12.4 WHAT CONSTITUTES A LACK OF CONFORMITY 

There is a lack of conformity when the purchased goods: 

i. are not suitable for the use for which goods of the same type are usually used;

ii.do not conform to the description given by the seller and do not possess the qualities of the goods that the seller has presented to the consumer as a sample or model;

iii. do not have the qualities and performance that are normal in goods of the same type, which the consumer can reasonably expect, given the statements made in advertising or labeling; 

iv. are not suitable for the particular use desired by the consumer and brought to the seller's attention at the time of conclusion of the contract, and which the seller has accepted.

Therefore, any malfunctions or failures determined by accidental events or attributable to the user's responsibility or to a use of the product not in accordance with its intended use and/or what is provided in the technical documentation attached to the product are excluded from the scope of application of the Legal Warranty. 

12.5 REMEDIES AVAILABLE TO THE USER 

In the event of a lack of conformity duly reported within the deadlines, the user is entitled to: 

i. primarily, free repair or replacement of the goods, at their choice, unless the remedy requested is objectively impossible or excessively burdensome compared to the other;

ii. secondarily (i.e., when repair or replacement is impossible or excessively burdensome, or repair or replacement has not been carried out within a reasonable time, or repair or replacement previously carried out has caused significant inconvenience to the consumer), to a price reduction or contract termination, at their choice.

The requested remedy is excessively burdensome if it imposes unreasonable expenses on the seller compared to alternative remedies that can be sought, taking into account (i) the value that the goods would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy can be sought without significant inconvenience to the consumer. 

12.6 WHAT TO DO IN THE PRESENCE OF A LACK OF CONFORMITY 

In the event that a product purchased on the Store, during the period of validity of the Legal Warranty, shows what could be a lack of conformity, the user can contact Customer Service, at the contact details indicated in Article 14. Customer Service will promptly respond to the communication, indicating to the user what steps they need to take next. 

The Product with which the user reports the lack of conformity must be sent to S4 GIUBILEO S.R.L., which will verify whether the reported defect exists or not, at the following address:

13. Applicable Law 

13.1 The purchase contract concluded on the Store is governed by Italian law. 

13.2 Users who do not have their habitual residence in Italy are subject to the more favorable and mandatory provisions of the law of the country where they have their habitual residence, in particular regarding the deadline for exercising the right of withdrawal, the deadline for returning the Products in case of exercising this right, the methods and formalities of communication of the same, and the legal warranty of conformity. 

13.3 For any dispute relating to the application, execution, and interpretation of these General Terms and Conditions of Sale, the competent court is the court of the place where the user resides or has elected domicile. 

13.4 Pursuant to Article 141-sexies, paragraph 3 of Legislative Decree 6 September 2005, No. 206 (Consumer Code), S4 GIUBILEO S.R.L. informs the user who qualifies as a consumer under Article 3, paragraph 1, letter a) of the Consumer Code that, in the event that they have submitted a complaint directly to S4 GIUBILEO S.R.L., following which it has not been possible to resolve the resulting dispute, S4 GIUBILEO S.R.L. will provide information regarding the Alternative Dispute Resolution (ADR) entity or entities for the extrajudicial resolution of disputes arising from a contract concluded based on these General Terms and Conditions of Sale (ADR bodies, as indicated in Articles 141-bis and following of the Consumer Code), specifying whether it intends to use such bodies to resolve the dispute or not. S4 GIUBILEO S.R.L. also informs the user who qualifies as a consumer under Article 3, paragraph 1, letter a) of the Consumer Code that a European platform for online dispute resolution for consumer disputes (the ODR platform) has been established. The ODR platform is accessible at the following address: http://ec.europa.eu/consumers/odr/; through the ODR platform, the consumer user can consult the list of ADR entities, find the link to the website of each of them, and initiate an online dispute resolution procedure in which they are involved. However, the right of the consumer user to bring an action before the competent ordinary judge for the dispute arising from these General Terms and Conditions of Sale, regardless of the outcome of the extrajudicial settlement procedure, as well as the possibility, if the conditions are met, to promote an extrajudicial resolution of disputes relating to consumer relationships through recourse to the procedures provided for in Part V, Title II-bis of the Consumer Code, are reserved. The user residing in a Member State of the European Union other than Italy may also access, for any dispute relating to the application, execution, and interpretation of these General Terms and Conditions of Sale, the European procedure established for low-value disputes, by Council Regulation (EC) No. 861/2007 of 11 July 2007, provided that the value of the dispute does not exceed, excluding interest, rights, and expenses, EUR 2,000.00.
